Commonwealth of Australia and Medicines Australia Memorandum of Understanding 2010
In May 2010, Medicines Australia (MoU) reached an agreement with the Commonwealth that was enshrined in a Memorandum of Understanding (MoU). The MoU was announced in the Federal Budget 2011-12.
The National Health Amendment (Pharmaceutical Benefits Scheme) Bill 2010 was passed by the Australian Parliament in November 2010 to give effect to some of the measures contained in the MoU.
The MoU covers the following issues:
- strengthened price disclosure arrangements;
- price reductions for certain drugs listed on the PBS;
- the creation of new therapeutic groups;
- the consistent treatment of brands of drugs sold at the same price;
- comparators;
- parallel Therapeutic Goods Administration (TGA) and PBAC processes;
- a managed entry scheme from 1 January 2011;
- timing and maximum time frames for PBS pricing negotiations and consideration by Cabinet; and
- resolution of issues in good faith.
